Why choose mediation?

Mediation is an alternative form for dispute resolution to securities arbitration or securities litigation. There are many advantages to mediation. Much of your decision will be based on the circumstances of your particular case. Securities mediation and arbitration are both much less costly than litigation. Mediation is a very informal process wherein the mediator discusses possible solutions and tries to help the disputing parties come to an agreement beneficial to both. Mediation is completely voluntary and the suggested solutions by the mediator are not legally binding. If one party, or both, does not accept the proposed solution, they can pursue other methods of resolution.

Looking at Your First Step in Mediation

The first step of mediation is to select a mediator. Both parties must agree on the mediator as unbiased and experienced in dispute resolution. In the first session, you or your legal representative and the opposing party will present the facts as you see them. You will then have the opportunity to meet with the mediator separately. The mediator, having heard both sides, will work with you to find an agreement that both parties approve. The Financial Industry Regulatory Authority (FINRA) reports that 75-80% of all securities mediations reach a successful resolution.
